Terms of Service
The plain-English rules for Sombrilla Hosting plans. Please read them before you sign up.

1. Who we are
Sombrilla Hosting is a service of Jennifer Ettia trading as Sombrilla Digital, ABN 96 507 192 054, based in the Sutherland Shire, NSW ("I", "me", "we", "us"). "You" means the business or person who signs up for a plan.

2. Your plan
Your plan (Essential, Business or Premium) includes the features listed on the packages section of this website at the time you sign up. Hosting is provided on Australian-based cloud infrastructure operated by a third-party provider and managed by me.
Your service starts once your first direct debit has been set up and your website is hosted with us.
3. Prices & payment
- All prices are in Australian dollars and include GST.
- Plans are billed monthly in advance by direct debit through GoCardless. Your direct debit is also covered by GoCardless's Direct Debit Request Service Agreement, which you accept when you set it up.
- If a payment fails, I'll let you know and try again. If a payment is still unpaid 14 days after it was due, I may suspend your services after giving you notice, until the account is up to date.
- I'll give you at least 30 days' notice in writing before any price change. If you don't want to continue at the new price, you can cancel under section 5.
- Tax invoices are issued for every payment.
4. Changing plans
You can move up or down a plan at any time by letting me know in writing (email is fine). The new price applies from your next billing date. If you move up, I can start the extra services straight away.
5. Cancelling
- You can cancel at any time by giving one month's notice in writing (email is fine). There's no lock-in contract.
- Your direct debit continues for the notice month, and your services keep running until the end of it.
- Payments already made for a month in progress are not refunded, except where the Australian Consumer Law requires a refund.
- Before your service ends, I'll help you move out: I'll provide your domain transfer code and a copy of your website files and database. Please make sure you have copies of your email, because mailboxes are removed once the service ends.
6. Your domain
- Domain registrations and renewals are charged at cost price, with no mark-up. They are billed separately from your monthly plan.
- Your details on the domain record must be accurate, as required by the domain registry rules (for .au domains, auDA's licensing rules). Please tell me if your business details change.
- If you leave, I'll give you the transfer code and help you move the domain to your chosen provider, provided your account is up to date.
- Premium plans include tracking of your domain renewal dates. For other plans, renewal reminders come from the registrar to the contact email on the domain record.
7. Updates & extra work
- Business plans include WordPress, plugin and software updates, and 30 minutes of content updates each month.
- Premium plans include updates and 1 hour of content updates each month.
- Unused update time doesn't carry over to the next month.
- Extra work is charged at $132 per hour inc. GST ($120 + GST), or $108.90 per hour inc. GST ($99 + GST) for Premium clients. This includes fixing contact forms and email delivery problems.
- For any job likely to take more than an hour, I'll give you an estimate before starting.
- Updates occasionally cause problems with a plugin or theme. I take a backup before making changes and will fix update-related problems I cause at no charge.
8. Support
- Essential: support during business hours (Monday to Friday, 9am to 5pm Sydney time, excluding NSW public holidays).
- Business: priority support with a text response.
- Premium: 24/7 emergency response if your website is down or has been hacked. Other requests are handled the same day.
Response means I'll acknowledge the problem and start working on it. Some problems take longer to fix, and I'll keep you updated.
9. Business email
- Essential includes 2 email accounts, Business includes 4, and Premium includes unlimited accounts. All are set up for you.
- "Unlimited" is subject to fair use. Mailboxes share server storage, so if your email storage becomes unusually large, I'll talk to you about options before anything changes.
- Google Workspace setup is available. Google Workspace licences are billed separately at Google's price.
- Email must not be used to send spam or bulk marketing. Use a dedicated email marketing service for newsletters.
10. Migration
- Moving an existing WordPress website to our hosting is free on all plans.
- Email migration (moving existing mailboxes and messages) is included on Premium, and quoted for other plans.
- Websites on other platforms (such as Wix or Squarespace) can't be moved as they are. A rebuild is quoted separately after your Health Check.
- You need to give me the access details required for the move, such as your old host, domain and admin logins.
11. Backups & availability
- Your website is backed up daily and backups are kept for a limited period. I take reasonable care to keep them, but I recommend you also keep your own copies of important content, such as photos and documents.
- I aim to keep your website online at all times, but no host can guarantee 100% uptime. Occasional outages can happen because of maintenance, third-party infrastructure or events outside my control. I'll work to restore service as quickly as possible.
12. Acceptable use
You must not use our hosting or email for anything illegal, for spam, for malware or phishing, to infringe anyone's copyright or trade marks, or in a way that harms the server or other clients' websites. I may suspend a website that breaches this, or that has been hacked and is putting other sites at risk. Where possible I'll contact you first.
13. Health Checks & Domain Check
The free Website Health Check and the Domain Check tool give general information based on what can be seen from outside your website and from public registry records. They're provided in good faith, but they aren't a full security audit and can't guarantee your website is free of problems.
14. Consumer law & liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits your rights under that law.
To the extent the law allows, if something goes wrong, my liability is limited to supplying the service again or refunding the fees you paid for the affected period. I'm not liable for indirect losses such as lost profits or lost business, except where the law says otherwise.
15. General
- I may update these terms from time to time. I'll give you at least 30 days' notice of any change that affects you, and the latest version will always be on this page.
- How I handle your personal information is explained in the Privacy Policy.
- These terms are governed by the laws of New South Wales, Australia.
